1. Introduction
Apany (the "Platform") enables users to create and publish listings of all types and receive quotes from verified buyers, dealers, or service providers. These Terms & Conditions ("Terms") set out the rights and obligations of all users of the Platform. By accessing or using Apany you agree to be bound by these Terms.
2. The Service
The Platform provides tools to publish listings, receive quotes from interested parties and connect buyers, sellers and service providers. Apany facilitates the exchange of listings and quotes; it does not buy, sell, or take possession of listed items or services and does not act as an escrow or payment processor.
3. Eligibility
You must be 18 or over and able to form legally binding contracts to use the Platform. By using the Platform you represent and warrant that you meet these requirements.
4. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
5. Listings
Users must provide accurate descriptions, photos and any information requested when creating a listing. Misleading, false or illegal listings are strictly prohibited. Users remain responsible for their listings and any representations made therein.
6. Quotes & Interaction
Quotes are manual, genuine offers submitted by verified buyers, dealers or service providers. Quotes may include conditional offers that require inspection, verification or further checks. Sellers should review the terms of any quote carefully before accepting. Apany does not guarantee the accuracy of quotes and is not responsible for transactions negotiated off-platform.
7. Transactions & Payments
Any transaction resulting from the Platform is between the buyer and the seller (or service provider). Apany is not a party to such transactions and does not process payments or hold funds. Parties should agree payment and collection/delivery terms directly and document arrangements.
8. Fees
There are currently no fees for individual listers to publish basic listings on Apany. We may introduce fees in the future for business customers, commercial accounts, or for certain premium features and services. Any such fees will be communicated with sufficient prior notice and published clearly on the Platform.
9. Intellectual Property
All content on the Platform, including text, images, and code, is owned by Apany or licensed to Apany. You may not reproduce, distribute, or create derivative works without prior written consent.
10. User Conduct
You agree not to use the Platform to: post unlawful content; harass others; send spam; or infringe the rights of third parties. We reserve the right to remove content that breaches these Terms.
11. Disclaimers & Limitations
The Platform is provided "as is". To the fullest extent permitted by law, Apany disclaims all warranties, express or implied. We are not liable for indirect, incidental or consequential damages arising from your use of the Platform.
12. Indemnity
You agree to indemnify and hold Apany and its affiliates harmless from any claims, damages or expenses arising out of your breach of these Terms or your use of the Platform.
13. Termination
We may suspend or terminate your access at any time for violations of these Terms or for legal reasons. You may close your account at any time by contacting us.
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the Platform or by email. Continued use after notice constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the United Kingdom. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the UK courts unless otherwise agreed.
